Terms & Conditions of Service
Effective Date: April 11, 2026
These Terms & Conditions (“Terms”) govern (1) your access to and use of the SafetyU Logistics website and (2) courier and related logistics services provided by SafetyU Logistics (“SafetyU,” "Safety University", “we,” “us,” “our”). By scheduling, tendering, or paying for services, you agree to these Terms.
1) Definitions
“Customer” / “you”: The individual or entity requesting services.
“Shipment” / “Package”: Any item(s) tendered to SafetyU for transport.
“Water Samples”: Whole effluent water samples and related chain-of-custody materials tendered for transport to a laboratory or receiving location.
“General Packages”: All Shipments other than Water Samples.
“Business Day”: Any day other than Saturday, Sunday, or a Bank-Recognized Holiday.
“Bank-Recognized Holiday”: A U.S. federal holiday as generally observed by U.S. banks and commonly recognized in business operations.
“Force Majeure Event”: Events beyond reasonable control (see Section 14).
2) Scope of Services
SafetyU provides small-package courier services in Wisconsin, Northern Michigan, and Minnesota, including specialized transport for Water Samples and delivery of General Packages. Service availability may vary by route, distance, weather, staffing, access constraints, road conditions, and receiving-site hours.
3) Authority
If you request services on behalf of a business or other entity, you represent you have authority to bind that entity to these Terms.
4) Service Levels and Delivery Commitments
4.1 Water Samples: Same-Day / Next-Day Guarantee (Within Service Area)
For whole effluent Water Samples, SafetyU guarantees same-day or next-day delivery when:
-
pickup and delivery locations are within the state of Wisconsin, eastern Minnesota, Upper Peninsula area of Michigan,
-
the receiving lab/location is open and able to accept delivery, and
-
the Shipment is properly packaged and labeled per Sections 7–9.
Guaranteed service is void if any of the above conditions are not met, if the recipient refuses/does not accept delivery, if access is not available, or if a Force Majeure Event occurs.
4.2 General Packages: Separate Service Levels
All non-water-sample deliveries are performed according to the service level selected at booking (e.g., same-day, next-day, scheduled route, etc.). Unless expressly labeled “Guaranteed” in writing at the time of booking, delivery times are estimates.
5) Scheduling, Pickup, and Delivery Rules

Accurate information required: You must provide correct addresses, contact names, phone numbers, access instructions, and receiving hours.

Access and waiting time: If our driver cannot access the pickup/delivery point (locked doors, security restrictions, unsafe conditions, missing contact, etc.), additional fees may apply and delivery commitments may be suspended.

Proof of delivery: We may obtain signature, photo, scan, or other proof of delivery unless you opt out in writing (when available).
6) Customer Responsibilities
You are responsible for:
-
Proper packaging, labeling, and sealing suitable for transport (Section 8),
-
Chain-of-custody documentation where applicable,
-
Ensuring items are legal to transport and not restricted/prohibited (Section 9),
-
Declaring any special handling needs at booking (fragile, temperature-sensitive, time-critical),
-
Maintaining any insurance you deem appropriate for your Shipment.
7) Water Samples: Handling and Chain of Custody
SafetyU will use commercially reasonable care in handling Water Samples, which may include transport in coolers and use of ice packs where operationally appropriate.
You acknowledge:
-
SafetyU does not control sampling method, sample integrity at tender, lab acceptance criteria, holding times, or lab test results.

You must specify any strict requirements at booking and package accordingly.
8) Packaging and Labeling Requirements
8.1 Water Samples
Customer must ensure (as applicable):
-
leak-proof primary containers,
-
secondary containment (e.g., sealed bag),
-
rigid cooler or protective container,
-
tamper-evident sealing where required,
-
correct labels and documentation.
-
If packaging is visibly inadequate (leaks, weak seals, unsafe container), SafetyU may refuse transport, pause service, or require repackaging at Customer’s cost.
8.2 General Packages
You must package items to withstand normal handling and transit. SafetyU is not liable for damage caused by inadequate or defective packaging.
9) Prohibited or Restricted Items (Including Hazardous Materials)
SafetyU Logistics does not transport hazardous materials (“HazMat”) and does not accept Shipments that require hazmat documentation, special markings/labels/placards, special packaging standards, or drivers with hazardous materials endorsements or similar credentials.
Unless SafetyU provides prior written approval (which we may withhold in our sole discretion), you may not tender:
-
any hazardous materials or dangerous goods (including regulated materials),
-
explosives, firearms, ammunition, controlled substances, or illegal goods,
-
items requiring specialized temperature control beyond what was booked,
-
any item prohibited by law.
If a Shipment is suspected or determined (by us or any authority) to contain HazMat or other prohibited contents, SafetyU may, at its option:
-
refuse pickup or delivery,
-
stop transport and secure the Shipment,
-
return the Shipment to sender (when lawful and safe),
-
surrender the Shipment to appropriate authorities, and/or
-
take any action we deem necessary for safety and legal compliance.
Any service commitments (including guarantees) are void for prohibited Shipments.
10) Rates, Payment, and Surcharges
Rates are as quoted/posted at booking and may be based on distance, urgency, size/weight, special handling, and wait time.
Payment terms: Net 30. Past-due balances may incur 1.5% per month (or the maximum permitted by law), plus collection costs.
You are responsible for applicable taxes, tolls, parking, and access fees unless included in the quote.
10.1 Holiday Surcharge
A $500 surcharge applies per delivery performed on any of the following holidays (or observed holiday). This surcharge is in addition to base delivery fees and any other premiums.
Holidays: New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Friday after Thanksgiving, Christmas Eve, and Christmas Day.
10.2 Late or Short Notice Surcharge
A surcharge applies to any order requested and confirmed with fewer than seventy-two (72) hours’ advance notice.
10.3 Pickup Delay Surcharge
A surcharge may apply for delays in package pickup attributable to the Client. Charges will accrue in fifteen (15) minute increments, commencing upon courier arrival at the scheduled pickup location.
10.4 Direct Transport Service
Direct transport service, defined as the dedicated movement of a package from the Client’s specified pickup location to the designated laboratory without intermediate stops, may be provided upon request and is subject to additional charges.
11) Cancellations and Changes
11.1 Cancellation Fee (Less Than 72 Hours)
If you cancel a scheduled pickup less than 72 hours before the scheduled pickup time, a $500 cancellation fee applies per scheduled stop / per reserved route (as applicable to your booking).
11.2 Changes / Rescheduling
Rescheduling requests within 72 hours may be treated as a cancellation plus a new booking, unless SafetyU agrees otherwise in writing.
12) Water Samples Non-Delivery Remedy (Up to $500)
If SafetyU fails to deliver Water Samples under a Guaranteed Water Samples booking (Section 4.1), SafetyU will reimburse the Customer’s documented cancellation costs that result directly from that non-delivery, up to $500 per non-delivery incident.
Conditions:
-
Customer must submit documentation (invoice/receipt) within 10 business days of the incident.
-
Reimbursement is limited to cancellation costs and does not cover lab fees, project delay costs, lost profits, regulatory penalties, or other consequential losses.
Exclusive remedy: This reimbursement is Customer’s exclusive remedy for a Water Samples guaranteed-service failure, except where prohibited by law.
Exclusions: The reimbursement in this Section does not apply to (a) Shipments containing prohibited or restricted items (including HazMat) under Section 9, (b) Shipments tendered with inaccurate/incomplete information, (c) Shipments not properly packaged/labeled, (d) recipient refusal/unavailability, or (e) delays/failures caused by a Force Majeure Event.
13) Limitation of Liability
13.1 No Consequential Damages
To the maximum extent permitted by law, SafetyU is not liable for any indirect, incidental, special, punitive, exemplary, or consequential damages (including lost profits, loss of business, loss of use, reputational harm, or project delays), even if advised such damages were possible.
13.2 Cap on Direct Damages (General Packages)
For General Packages, SafetyU’s maximum liability for any claim (loss, damage, delay, misdelivery) is limited to the lesser of:
-
(a) $500 per Shipment, or
-
(b) the documented replacement cost of the contents, or
-
(c) any lower amount required by the applicable service level purchased (if stated in writing).
If you need higher coverage, request declared value coverage or separate insurance before tendering the Shipment (if offered).
13.3 Water Samples
For Water Samples under the guarantee, Section 12 governs. For non-guaranteed Water Samples service, liability (if any) is limited as in Section 13.2.
13.4 No Coverage for Prohibited Shipments (Including HazMat)
SafetyU has no liability and will provide no reimbursement, credit, or compensation of any kind (including under any service guarantee) for any claim arising from or related to a Shipment that contains or is alleged to contain HazMat or other prohibited/restricted items, or that otherwise requires special endorsements or documentation, as described in Section 9 - except to the extent such limitation is prohibited by applicable law.
14) Force Majeure (Acts of God and Similar)
SafetyU is not responsible for delays, non-performance, or failures caused by a Force Majeure Event, including but not limited to: severe weather, flood, fire, natural disaster, epidemic/pandemic, war, terrorism, civil unrest, strikes/labor disruptions, road closures, power/communications outages, government orders, or other events beyond our reasonable control.
If a Force Majeure Event occurs, delivery commitments (including guarantees) are suspended for the duration of the event. SafetyU will make commercially reasonable efforts to resume service promptly.
15) Claims Process and Time Limits
To file a claim, email info@safetyulogistics.com and include:

order number,
-
description of issue,
-
photos (if damage),
-
documentation of value or costs.
Time limits:
-
Water Samples: notify within 72 hours of the scheduled delivery time.
-
General Packages: notify within 7 calendar days of delivery (or expected delivery date if not delivered).
No claims for prohibited items: Claims will not be accepted for Shipments that contain prohibited or restricted items (including HazMat) under Section 9.
16) Indemnification
16.1 General Indemnification
You agree to defend, indemnify, and hold harmless SafetyU (including its owners, employees, agents, and contractors) from claims, damages, penalties, and expenses (including reasonable attorneys’ fees) arising from:
-
your breach of these Terms,
-
improper packaging or labeling,
-
undisclosed special handling needs,
-
inaccurate instructions or recipient unavailability,
-
illegal/prohibited contents.
16.2 Hazardous Materials - Customer Responsibility for All Costs
You represent and warrant that Shipments tendered to SafetyU do not contain hazardous materials or dangerous goods and do not require hazmat endorsements, placards, permits, registrations, or special documentation.
If any Shipment is found, alleged, or determined to contain HazMat or otherwise require special endorsements/documentation, Customer is solely responsible for and agrees to defend, indemnify, and hold harmless SafetyU from all losses, damages, liabilities, penalties, and expenses arising from or related to that Shipment, including without limitation:
-
governmental fines and penalties,
-
remediation/cleanup and disposal costs,
-
towing/storage/containment costs,
-
legal fees and court costs,
-
investigation costs,
-
claims by third parties, and
-
operational disruption or delays.
This obligation applies regardless of whether Customer knew or should have known the Shipment contained prohibited materials.
17) Website Use
All website content is owned by SafetyU or its licensors and may not be copied or reused without permission. The website is provided “as is” without warranties of uninterrupted or error-free operation.
18) Privacy
Our collection and use of personal information is described in our Privacy Policy: [link].
19) Governing Law and Venue
These Terms are governed by the laws of Minnesota, without regard to conflict-of-law rules. Any dispute must be brought in state or federal courts located in Carlton County, Minnesota, and you consent to jurisdiction and venue there.
20) Changes to These Terms
SafetyU may update these Terms from time to time. The “Effective Date” above reflects the current version. Continued use of services after an update constitutes acceptance of the updated Terms.
